Terms of Service
1. Acceptance
By creating an account or using Footagen.ai, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the platform. These Terms form a binding agreement between you and Frame Rate Oy ("Footagen", "we", "us").
2. The service
Footagen.ai is an AI-native film production platform that combines script analysis, shot breakdown and planning, visual style and production design, character, location and prop creation, a node-based canvas per shot on a production timeline, automated prompt generation, continuity verification, and AI image, video and audio generation — with upscaling and export for external editing (NLE) software. The platform is provided on a subscription basis.
3. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for keeping your login credentials secure.
- One account per person unless you hold a Team or Enterprise plan.
- You are responsible for all activity under your account.
4. Subscriptions and billing
Footagen.ai is not yet publicly available. The waitlist for early access is open, and selected waitlist users will be invited to the beta in batches during the remainder of 2026. Plan tiers and pricing will be decided and published at footagen.ai once the test period has ended. Footagen.ai is being priced to be accessible rather than exclusive, with plans intended to suit individual filmmakers through to production companies and studios.
Once available, subscriptions are billed monthly in advance. Prices will be listed in EUR and include VAT where applicable. We reserve the right to change prices with 30 days' notice. Custom Enterprise pricing is available on request — contact hello@footagen.ai.
You may cancel your subscription at any time. Access continues until the end of the billing period. No refunds are issued for partial months.
5. Credits
Generation credits are consumed when you generate images, video or audio. Credits do not expire at the end of the calendar month — they remain in your account until used or until your account is closed. Credits are non-transferable and have no cash value.
6. Your content
You retain full ownership of the content you create, upload or generate using Footagen.ai — including screenplays, prompts, assets and generated footage. You grant Footagen a limited, non-exclusive licence to process and store your content solely to provide the service.
We do not use your content to train AI models.
You are responsible for ensuring that the content you upload or generate does not infringe third-party rights and complies with applicable law, including the EU AI Act.
7. Acceptable use
You may not use Footagen.ai to:
- Generate content that depicts illegal activity, non-consensual intimate imagery, or content that sexualises minors.
- Create deepfakes of real individuals without their consent for deceptive purposes.
- Circumvent the platform's safety systems or attempt to extract model weights.
- Resell access to the platform without authorisation.
- Violate any applicable law or regulation.
Footagen reserves the right to suspend or terminate accounts in breach of these rules without notice.
8. AI-generated content disclosure (EU AI Act)
Footagen.ai attaches a production record to every generated file, documenting the AI model and provider used, the generation parameters, and the asset references. You are responsible for complying with applicable disclosure obligations, including those under the EU AI Act, when publishing AI-generated content.
9. Intellectual property
The Footagen.ai platform, interface, branding and proprietary technology are owned by Frame Rate Oy. You may not copy, reverse-engineer or create derivative works of the platform without our written permission.
10. Third-party AI models
Footagen.ai integrates third-party AI models from providers including but not limited to Google, ByteDance, MiniMax and OpenAI. The specific models available through the platform may change over time as the underlying AI landscape evolves; current models are listed at footagen.ai. Use of these models through our platform is subject to the respective providers' terms. We are not responsible for the output of third-party models beyond our platform's own processing.
11. Limitation of liability
To the maximum extent permitted by law, Footagen's liability to you for any claim arising from use of the platform is limited to the subscription fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential or punitive damages.
The platform is provided "as is". We do not warrant that AI-generated output will be accurate, fit for purpose or free from error.
12. Governing law
These Terms are governed by the laws of Finland. Disputes shall be submitted to the jurisdiction of Finnish courts. EU consumers retain the right to bring claims in their country of residence.
13. Changes to these Terms
We will notify you by email of material changes at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the revised Terms.
